Il CPR e i prodotti innovativi
Il CPR prevede tre categorie di prodotto:
- Prodotti che rientrano in una norma armonizzata;
- Prodotti che non rientrano interamente in una hEN quando, cioè, esiste una norma armonizzata ma per almeno una delle caratteristiche essenziali del prodotto si verifica che:
- il metodo di valutazione non è appropriato;
- non esiste un metodo di valutazione;
- Prodotti che non rientrano nell’ambito di applicazione di una norma armonizzata.
Per i prodotti che rientrano nel 1° gruppo, la Dichiarazione di Prestazione e la conseguente marcatura CE sono obbligatori.
Per i prodotti che rientrano nei gruppi 2 e 3 se il fabbricante ha scelto di dichiarare le prestazioni, può avvalersi di un EAD e conseguente rilascio di un ETA da parte di organismo di valutazione tecnica designato (TAB) e, quindi, apporre la marcatura CE dopo aver applicato il sistema di AVCP previsto dall’EAD
Organismi di valutazione tecnica (TAB)
Si tratta di organismi i cui requisiti sono definiti nell’Allegato IV del CPR e designati dai rispettivi Stati membri per la redazione di EAD e per il rilascio degli ETA. Il nome e l’indirizzo di ciascun TAB e le aree di prodotto per le quali sono designati sono comunicati alla Commissione europea e agli altri Stati membri.
I TAB rilasciano Valutazioni Tecniche Europee (ETA) per le aree di prodotto (di cui Allegato IV del CPR) per le quali sono stati designati e sono competenti per le medesime aree a predisporre EAD.
Una volta ottenuto l’ETA per il proprio prodotto, il fabbricante per redigere la DoP e apporre la marcatura CE deve svolgere le attività di AVCP; nel caso di sistemi AVCP che prevedono l’intervento di Organismi Notificati il Fabbricante deve rivolgersi a tali Organismi al fine di ottenere il Certificato della costanza di prestazione (per sistemi AVCP 1 o 1+) o il Certificato di conformità del controllo della produzione in fabbrica.
Marcatura CE sulla base di un ETA
Il fabbricante che richiede il rilascio di un ETA intraprende un percorso di certificazione volontaria. Una volta ottenuto l’ETA, l’unico modo per poter esprimere le prestazioni relative alle caratteristiche essenziali conformemente al rispettivo documento per la valutazione europea è attraverso la DoP. Nella DoP verrà indicato il numero del Documento per la Valutazione Europea (EAD) e il numero della Valutazione Tecnica Europea (ETA) rilasciato per il prodotto in questione. Anche in questo caso, il Fabbricante per poter redigere la DoP dovrà applicare il corretto sistema di AVCP e ricorrere, quando previsto, all’intervento dell’Ente Notificato. Si ricorda infine che l’ ETA non ha scadenza.
ETA – VALUTAZIONE TECNICA EUROPEA
La Valutazione Tecnica Europea (in inglese European Technical Assessment – ETA) è definito dal CPR 305/2011 come “la valutazione documentata della prestazione di un prodotto da costruzione, in relazione alle sue caratteristiche essenziali, conformemente al rispettivo documento per la valutazione europea”.
L’ETA è un documento di natura volontaria che contiene le prestazioni delle caratteristiche essenziali di un prodotto da costruzione; esso è rilasciato per prodotti che non rientrano nel campo di applicazione di una norma armonizzata o che per almeno una delle caratteristiche essenziali il metodo di valutazione non è appropriato o non esiste. ; Il rilascio dell’ETA si basa sulla specifica tecnica armonizzata “Documento per la Valutazione Europea (European Assessment Document – EAD)”.
Il rilascio di ETA, così come la definizione di appositi EAD, è competenza dei Technical Assessment Body (TAB). ITC è TAB designato su molte aree di prodotto (Product Areas – PAC) e può quindi definire EAD, o collaborare alla loro definizione, e rilasciare ETA. Con il D.lgs. 106/2017 è stato istituito l’ Italian Technical Assessment Body, ovvero l’ unico TAB a livello nazionale a cui faranno capo tutte le aree di prodotto. Nelle more della definizione delle modalità di funzionamento di ITAB, sulla base di un Protocollo d’Intesa tra il Servizio Tecnico Centrale del Consiglio Superiore dei Lavori Pubblici e l’Istituto per le Tecnologie della Costruzione del Consiglio Nazionale delle Ricerche, quest’ultimo riceve e segue l’istruttoria per il rilascio di ETA anche per le PAC per le quali era designato STC (https://ec.europa.eu/growth/tools-databases/nando/index.cfm?fuseaction=notification.pdf&dir_id=33&ntf_id=283457 ).
L’ETA di un prodotto contiene la/le prestazione/i da dichiarare, espressa/e in livelli o classi, o in una descrizione, delle caratteristiche essenziali scelte dal fabbricante tra quelle previste dall’EAD di riferimento e il sistema di valutazione e verifica della costanza della prestazione (VVCP).
E’ possibile richiedere di intraprendere un procedimento per rilascio di un ETA inviando un’e-mail all’indirizzo: segreteria.itab” at “itc.cnr.it.
La richiesta di copia di un ETA deve essere rivolta all’Azienda proprietaria del documento e non a ITC-CNR.
The CPR and innovative products
The CPR sets out three product categories:
- Products covered by a harmonized standard;
- Products that are not fully covered by a harmonised standard, that is, when a harmonized standard exists but for at least one of the product’s essential characteristics:
- the assessment method is not appropriate;
- the harmonised standard does not provide for any assessment method;
- Products do not fall within the scope of any existing harmonised standard;
For products in category 1, the Declaration of Performance and related CE marking are mandatory.
For products in category 2 and 3, if the Manufacturer decided to submit a Declaration of Performance, he may use an EAD followed by the issuing of an ETA by a designated Technical Assessment Body (TAB) and, then, affix the CE marking after he has implemented the AVCP system as stated in the EAD.
Technical Assessment Bodies (TABs)
TABs are organisations whose requirements are defined in Annex IV to the CPR and designated by their respective Member States as competent to produce EADs and to issue ETAs. The name and address of each TAB and the product areas for which it is designated are communicated to the European Commission and to other Member States.
TABs issue European Technical Assessments (ETAs) in the product areas (listed in Annex IV to the CPR) for which they have been designated and are competent to produce EADs in the same areas.
Once an ETA has been issued for a product, the Manufacturer shall carry out the AVCP activities in order to draw up the DoP and affix the CE marking; if the AVCP systems involves Notified Bodies, the Manufacturer shall address them in order to obtain the Certificate of constancy of performance (for AVCP systems 1 or 1+) or the Certificate of conformity of factory production control.
CE Mark based on ETA
The Manufacturer applying for an ETA undertakes a voluntary certification process. Once he has obtained the ETA, the only way to express the performance relating to the essential characteristics in accordance with the respective European Assessment Document is through the DoP. The DoP will indicate the number of the European Assessment Document (EAD) and the number of the European Technical Assessment (ETA) issued for the product in question. In this case as well, in order to draw up the DoP, the Manufacturer shall apply the correct AVCP system and resort, when required, to the intervention of the Notified Body. Finally, it should be noted that the ETA has no expiration date.
ETA – EUROPEAN TECHNICAL ASSESSMENT
CPR 305/2011 defines the European Technical Assessment – ETA as “the documented assessment of the performance of a construction product, in relation to its essential characteristics, in accordance with the respective European Assessment Document”.
The ETA is a document issued on a voluntary basis providing information on the performance of a construction product in relation to the essential characteristics; it is issued for products that do not fall within the scope of a harmonized standard or that for at least one of the essential characteristics, the assessment method is not appropriate or does not exist; the issuing of the ETA is based on the harmonized technical specification “European Assessment Document” – EAD.
ETAs are issued by the Technical Assessment Body (TAB) that also defines the relevant EADs. ITC is a TAB designated for many Product Areas (PACs) so it can define EADs, or collaborate in their definition, and issue ETAs. The Italian Technical Assessment Body (ITAB) was established by virtue of Italian Legislative Decree 106/2017. This Body is the only TAB at national level which will cover all the product areas (PACs). Pending the definition of ITAB’s operating procedures, on the basis of the Memorandum of Understanding entered into by the Italian Central Technical Service of the Superior Council of Public Works and the Construction Technologies Institute of the National Research Council Italy, the latter receives and takes on the preliminary activity for the issuing of ETAs also for the PACs for which STC was designated (https://ec.europa.eu/growth/tools-databases/nando/index.cfm?fuseaction=notification.pdf&dir_id=33&ntf_id=283457 ).
The ETA for a product shall include the performance to be declared, by levels or classes, or in a description, of those essential characteristics chosen by the Manufacturer among those provided for in the relevant EAD, and the system of assessment and verification of constancy of performance (AVCP).
