Adaptation of the Italian national regulations to the provisions of Regulation (EU) 305/2011

Italian Legislative Decree 106 of 16.6.2017 “Adaptation of the Italian national regulations to the provisions of Regulation (EU) 305/2011” was published in the Italian Official Journal 159 of 10.7.2017.

The Legislative Decree introduces significant new features on the subject of qualification and certification of construction products. Most of all, it provides for, for the first time ever, criminal sanctions for designers and site managers in case of breaches of the obligations introduced by the European Regulation for Construction Products (CPR 305/2011) as far as design and acceptance of materials in the construction site are concerned.

The Italian National Body for the European Technical Assessment (ITAB) is established by virtue of this Decree. It is a coordination Body whose staff is constituted by members of the Italian Central Technical Service of the Superior Council of Public Works of the Italian Ministry of Infrastructures and Transport, the Central Directorate for Technical Safety and Prevention of the Ministry of the Interior and the Construction Technologies Institute of the National Research Council of Italy.

With the entry into force of the Decree, designers and site managers can require and accept, respectively, only construction materials, products and systems with CE mark issued by a Notified Body, based on:
• a harmonized technical standard (EN), in case of traditional and/or well-established technologies;
• a European Technical Assessment (ETA) in case of innovative technologies.

However, the CE mark is a necessary, but not a sufficient condition for ensuring compliance with national technical standards. Within their respective areas of competence, designers and site managers shall work in compliance with both “European” and national requirements.

This is a completely new and extremely important subject for technical professions in general, even more so for newly trained professionals who are faced with new responsibilities and the expected criminal sanctions related to them.
Unfortunately, this subject has not yet made it to University classrooms and it is therefore little known to designers and site managers.

This Institute is the organization of the National Research Council of Italy that deals with constructions. It is the only Italian Body to be both a Notified Body for issuing the CE marking and a Technical Assessment Body (TAB) for issuing European Technical Assessments (ETAs) designated by the Italian government; ITC-CNR represents Italy in EU meetings and forums on construction products, which therefore makes it the most qualified national institution on the subject.

ITC-CNR is well aware of the economic and social value of this specific subject and in view of the fact that it is far from widespread among technical professions at national level (whereas such is not the case in other EU Countries), the Institute has worked towards the organization of advanced training courses, due to start next autumn. The courses will include recognition of CFPs (Professional Training Credits) and are intended to provide all those interested with a general but exhaustive overview of the contents of national and European certification of construction products and the new responsibilities imposed on technical professionals by Legislative Decree 106/2017.
